1. Acceptance of Terms

By accessing or using InkLoom (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and InkLoom. Your continued use of the Service following any modifications to these Terms constitutes acceptance of those changes.

2. Description of Service

InkLoom provides an AI-powered documentation platform that enables users to create, manage, and deploy documentation sites. The Service includes features such as document editing, AI-assisted content generation, version control integration, team collaboration, and site hosting. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. User Accounts & Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account. You agree to notify us immediately of any unauthorized use of your account. Users must be at least 18 years of age, or at least 13 years of age with a parent or legal guardian who agrees to these Terms and supervises their use. Users under 13 are not permitted to use InkLoom. Parents and guardians who set up accounts for minors between 13-17 are responsible for the minor's use of the Service and agree to these Terms on their behalf. You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations.

4. Acceptable Use

You agree not to use the Service to: (a) violate any applicable law or regulation; (b) infringe upon the rights of others; (c) distribute malware, spam, or other harmful content; (d) attempt to gain unauthorized access to the Service or its related systems; (e) interfere with or disrupt the integrity or performance of the Service; (f) use the Service for any unlawful, fraudulent, or malicious purpose; or (g) reverse-engineer, decompile, or disassemble any part of the Service.

5. Intellectual Property

The Service, including its original content, features, and functionality, is owned by InkLoom and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of any content you create using the Service. By using the Service, you grant InkLoom a limited license to host, store, and display your content solely for the purpose of providing the Service to you. Content generated by InkLoom AI features is owned by the owner of the project in which it was generated. InkLoom claims no ownership over AI-generated content. You are responsible for reviewing and verifying the accuracy of AI-generated content before publishing.

6. Open Source Software

Portions of InkLoom are available as open source software under separate license terms. Your use of the open source version is governed by the applicable open source license, not these Terms. These Terms govern your use of the InkLoom hosted platform (the Service), which includes additional proprietary features, infrastructure, and services not available in the open source version.

7. Payment & Billing

Certain features of the Service require a paid subscription. By subscribing to a paid plan, you agree to pay all fees associated with your chosen plan. Fees are billed in advance on a monthly or annual basis depending on your selection. Paid subscriptions include a 14-day money-back guarantee from the date of initial purchase. After 14 days, all payments are non-refundable except as required by applicable law. Refund requests should be sent to billing@inkloom.io. We reserve the right to change our pricing with reasonable notice. Free plan accounts are subject to usage limits as described in our pricing page. We reserve the right to modify free plan limits with reasonable notice. If free plan limits are reduced, existing content will not be deleted but creation of new content may be restricted until within limits.

8. Limitation of Liability

To the maximum extent permitted by applicable law, InkLoom and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from: (a) your use or inability to use the Service; (b) any unauthorized access to or alteration of your content; or (c) any other matter relating to the Service.

9. Indemnification

You agree to indemnify, defend, and hold harmless InkLoom and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you create, publish, or distribute through the Service.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. InkLoom does not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability. You may terminate your account at any time by contacting us or through the account settings. Upon voluntary cancellation of your account, you will have 30 days to export your data before it is permanently deleted. During this grace period, your published sites will be taken offline but your content will remain accessible for export through the dashboard or CLI. InkLoom reserves the right to immediately terminate accounts and delete data without a grace period in cases of Terms violations, fraud, or abusive use.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Delaware, and the parties consent to personal jurisdiction and venue therein.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms.
